Terms of Service

Important: CheckMate is an AI-powered study and practice tool. It is not a substitute for FAA-approved flight training, certified flight instruction, or any official examination process. Use of CheckMate does not satisfy any FAA regulatory requirement.
1. Acceptance of Terms
CheckMate is a product of Checkmate AI LLC ("Company", "we", "us", "our"). By creating an account or using CheckMate ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including free and paid subscribers.
2. Description of Service
CheckMate provides AI-simulated oral examination practice for FAA certificate and rating candidates, including Private Pilot License (PPL), Instrument Rating (IR), Commercial Pilot License (CPL), Airline Transport Pilot (ATP), Certified Flight Instructor (CFI), and related certificates. The Service generates practice questions, simulates examiner dialogue, and provides automated debrief reports based on your responses.
3. Eligibility
You must be at least 16 years of age to use the Service. By using CheckMate, you represent that you meet this requirement. If you are between 16 and 18 years of age, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. The Service is intended for aviation students, pilots, and flight instructors.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to suspend or terminate accounts that violate these Terms.
Only one active session per account is permitted at a time. Attempting to circumvent this limit may result in account suspension.
5. Subscriptions and Billing
CheckMate offers both free and paid subscription tiers. Paid plans are billed through Stripe, a third-party payment processor.
- Monthly subscriptions renew automatically each month until cancelled.
- Annual subscriptions renew automatically each year until cancelled.
- One-time packages grant access for the stated duration and do not renew.
- You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period.
- We do not offer refunds for partial billing periods, except where required by applicable law.
We reserve the right to change pricing with 30 days' notice to active subscribers.
6. Free Tier
Free accounts are limited to two (2) oral exam sessions per calendar month and access to PPL content only. We reserve the right to modify free tier limits at any time.
7. Promo Codes
Promotional codes are for single use and may not be shared, sold, or transferred. We reserve the right to revoke promo access if codes are misused.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to reverse-engineer, scrape, or extract content from the Service
- Share your account credentials with others
- Use automated tools to interact with the Service
- Misrepresent AI-generated content as official FAA guidance or examiner feedback
- Attempt to manipulate the AI to produce misleading aviation safety information
9. Intellectual Property
All content, branding, and software comprising CheckMate is owned by or licensed to Checkmate AI LLC. You may not reproduce, distribute, or create derivative works without written permission.
FAA regulations, ACS standards, and other government-published materials referenced within the Service remain in the public domain.
10. User Content
When you use CheckMate, you submit responses and messages as part of simulated exam sessions ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Checkmate AI LLC a limited license to process and analyze that content solely to provide and operate the Service.
We do not use your User Content to train AI models. We do not store the full text of your exam conversations beyond what is needed to deliver your session results, as described in our Privacy Policy.
11. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT AI-GENERATED CONTENT IS ACCURATE, COMPLETE, OR CURRENT. CHECKMATE IS NOT AN FAA-APPROVED TRAINING RESOURCE AND DOES NOT GUARANTEE PASSAGE OF ANY EXAMINATION.
Aviation safety depends on proper training, currency, and judgment. You are solely responsible for verifying any information obtained through the Service with authoritative sources, including the FAA, your flight instructor, and current regulations.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKMATE AI LLC AND ITS OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
Our total liability to you for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid us in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold harmless Checkmate AI LLC and its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
14. Termination
We may suspend or terminate your access at any time for violation of these Terms or for any other reason with reasonable notice. Upon termination for cause, your right to use the Service ceases immediately with no refund. If we terminate your account without cause, paid subscribers will receive a pro-rated refund for any unused portion of their prepaid period.
15. Changes to Terms
We may update these Terms at any time. We will notify active subscribers by email of material changes. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
16. Dispute Resolution — Informal Resolution
If you have a dispute with us, please start by emailing us at support@checkmatepilot.com with a description of the issue. We ask that you give us 30 days to attempt informal resolution before initiating arbitration or any formal legal proceeding.
17. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.
17.1 Agreement to Arbitrate. Except for disputes that qualify for small claims court, you and Checkmate AI LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service — including questions about the existence, validity, or termination of these Terms — shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in a court of law. The AAA's rules are available at www.adr.org.
17.2 Arbitration Procedures. Arbitration will be conducted by a single neutral arbitrator. If your claim does not exceed $10,000, the arbitration may, at your election, be conducted entirely by telephone, video conference, or based solely on written submissions. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
17.3 Costs. The AAA filing fee is your responsibility up to the amount you would pay to file in small claims court. Checkmate AI LLC will pay all remaining AAA administration fees and arbitrator fees for claims that do not exceed $75,000, unless the arbitrator finds your claim frivolous.
17.4 CLASS ACTION WAIVER. YOU AND CHECKMATE AI LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, PRIVATE ATTORNEY GENERAL, OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person's claims and may not preside over any form of class or representative proceeding. If this class action waiver is found unenforceable, then the entirety of this arbitration agreement shall be null and void.
17.5 Exceptions. Notwithstanding the above, either party may bring an individual action in small claims court. Either party may also seek emergency injunctive or other equitable relief from a court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights, pending arbitration.
17.6 Opt-Out. If you do not wish to be bound by this arbitration agreement, you must notify us in writing at support@checkmatepilot.com within 30 days of first creating your account. Your opt-out notice must include your name, email address, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.
18. Governing Law
These Terms are governed by the laws of the State of Washington, without regard to conflict of law principles. Any disputes shall be resolved in the courts of King County, Washington.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Checkmate AI LLC regarding the Service.
20. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary. The remaining provisions will continue in full force and effect.
21. Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.
22. Force Majeure
We will not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including natural disasters, power outages, internet disruptions, government actions, or failures of third-party services.
